Privacy policy

1. Controller

2. Principles of processing

We process personal data only to the extent necessary to provide a functioning website and to handle your enquiries. Personal data is any information relating to an identified or identifiable natural person. We do not sell data, do not pass it on for advertising purposes and do not use any analytics, advertising or social media services.

3. Visiting the website and server log files

When you visit our website, your browser automatically sends information to our host's server. It is stored temporarily in so-called log files:

• IP address of the requesting device,
• date and time of access,
• name and URL of the file retrieved,
• browser used and, where applicable, the operating system,
• the page visited before (referrer).

The legal basis is our legitimate interest in the technical provision and security of the website (Art. 6(1)(f) GDPR). The log files are deleted after a short time unless, exceptionally, they are needed to investigate security incidents.

4. Hosting, email, storage and team chat

We host our website, run our email mailboxes, store form submissions in our cloud storage (kDrive) and receive notices of new submissions in our internal team chat (kChat). All four services are operated on our behalf by Infomaniak Network SA, Rue Eugène-Marziano 25, 1227 Geneva, Switzerland, on the basis of a data processing agreement (Art. 28 GDPR).

The servers are located in Switzerland. The European Commission has adopted an adequacy decision for Switzerland; transfers are therefore permitted under Art. 45 GDPR without additional safeguards.

5. Forms on this website

There are four forms on our website. For forms 5.1 to 5.3:

• Your details are stored in a file on our web server, in a directory that is blocked from access over the internet, and copied to our cloud storage (kDrive) after each submission. Both are with Infomaniak (section 4).
• A short notice appears in the team chat (kChat) with the type of request and rough details (for test households postcode and town, for care providers organisation, type, role and town). It contains neither your name nor your email address or phone number.
• We also store the time of submission, the language and address of the page with the form, the page you came from (referrer) and a salted hash of your IP address in order to detect duplicate and abusive submissions. The IP address itself is not stored. To limit submissions to a few per hour, the same hash is stored together with the times of your submissions in the server's temporary directory; only submissions from the last hour are evaluated.
• All fields not marked “optional” are required. Without them we cannot process your entry or enquiry; all other details are voluntary.
• We do not ask for health data. Please do not enter any health information in free-text fields — neither about yourself nor about anyone else.

5.1 Waitlist

By joining the waitlist, you ask us to inform you as soon as the device can be ordered. Joining is free of charge and does not create a contract. We process:

• name and email address,
• who the device would be for (selection),
• country,
• phone number (voluntary),
• your consents (storage; news by email if you choose).

The legal basis is your consent (Art. 6(1)(a) GDPR). If you have also chosen to receive news, we will email you about once a month. You can withdraw both consents at any time with effect for the future, informally to data@takecarehub.com. We delete your entry after you withdraw your consent, at the latest 24 months after receipt.

5.2 Applying as a test household

You can apply to test a device at home free of charge before launch. No purchase contract is formed, and it is not a medical study. We process:

• name and email address,
• country, postcode and town,
• street and house number (voluntary),
• who the device would be for (selection),
• your description of the room,
• phone number (voluntary),
• your confirmations in the form.

The legal basis is your consent (Art. 6(1)(a) GDPR), which you can withdraw at any time with effect for the future. Your application does not trigger any data processing in your home. A test only begins once you have received in writing what the device records in operation and every person living in the household has consented separately. That agreement is not covered by this policy. We delete applications after you withdraw your consent, at the latest 24 months after receipt.

5.3 Enquiries from care providers

Through the enquiry form for care services and facilities we process:

• name, email address and phone number,
• organisation, type of provider, your role,
• number of residents or clients (selection), town or region,
• your concern and your question to us,
• your consent to storage.

The legal basis is your consent (Art. 6(1)(a) GDPR), which you can withdraw at any time with effect for the future, and Art. 6(1)(b) GDPR (pre-contractual measures at your request). We do not add you to any mailing list. We delete the data as soon as your enquiry has been fully dealt with, unless statutory retention obligations prevent this.

5.4 Contact form

Through the contact form we process:

• name and email address,
• your message,
• time of submission, language and address of the page with the form.

Your message is not stored on the web server but delivered as an email to our mailbox info@takecarehub.com (Infomaniak, section 4). A notice with the language and page appears in the team chat (kChat), without your name, email address or message. To protect against abuse, a salted hash of your IP address is stored together with the times of your submissions in the server's temporary directory; only submissions from the last hour are evaluated. All fields are required. Please do not enter any health information.

The legal basis is Art. 6(1)(b) GDPR where your enquiry aims at a contract, and otherwise our legitimate interest in answering enquiries (Art. 6(1)(f) GDPR). We delete the email as soon as your enquiry has been fully dealt with, unless statutory retention obligations prevent this.

6. Job applications

We receive applications for our job openings through a form provided by Tally: Tally BV, Sint-Pietersnieuwstraat 11, 9000 Ghent, Belgium. Tally processes your details on our behalf (Art. 28 GDPR) and, according to Tally, stores them on servers in the European Union. To protect against automated submissions, Tally uses Cloudflare Turnstile, which transfers your IP address and browser characteristics to Cloudflare, Inc. (USA). Cloudflare is certified under the EU-US Data Privacy Framework; the transfer is based on the European Commission's adequacy decision on it (Art. 45 GDPR). The form shows which details are required. We process the details in your application to carry out the application process. The legal basis is Art. 6(1)(b) GDPR in conjunction with § 26 BDSG (German Federal Data Protection Act). We delete your application data six months after our decision unless you have consented to longer storage.

7. Storage on your device

We do not use cookies. When a page loads, we store its language in your browser's local storage. When you open the home page without a language in the address (takecarehub.com), we show it in that language:

• Name: tc-lang — value: de or en
• Storage period: until you delete the website data in your browser
• Purpose: solely to show the home page in the language you last read

The entry does not leave your device. The storage is strictly necessary for the service you have expressly requested (§ 25(2) no. 2 TDDDG) and therefore does not require consent.

8. Fonts

The fonts used on this website are served locally from our own server. Loading them does not connect to any third-party server, and no personal data (in particular no IP address) is transferred to third parties.

9. Your rights as a data subject

Subject to the statutory requirements, you have the following rights:

• right of access to the data we process (Art. 15 GDPR),
• right to rectification of inaccurate data (Art. 16 GDPR),
• right to erasure (Art. 17 GDPR),
• right to restriction of processing (Art. 18 GDPR),
• right to data portability (Art. 20 GDPR),
• right to object to processing (Art. 21 GDPR),
• right to withdraw consent at any time with effect for the future (Art. 7(3) GDPR).

To exercise your rights, an informal message to data@takecarehub.com is enough.

10. Right to lodge a complaint with a supervisory authority

Without prejudice to any other remedy, you have the right to lodge a complaint with a data protection supervisory authority if you consider that the processing of your data infringes the GDPR (Art. 77 GDPR), in particular in the Member State of your habitual residence, place of work or place of the alleged infringement.

11. Processing when our device is in operation

This privacy policy covers this website only. The processing of data while our device is in operation — in private households as well as in care facilities and home care — is not covered by this policy. It is governed separately: for households by a separate notice and consent before the device is put into operation, for facilities and operators by contract, in particular by data processing agreements under Art. 28 GDPR.

12. Changes to this privacy policy

We update this privacy policy as soon as changes to the processing we carry out make it necessary. The current version published on this page applies.
